Who we are and what these terms cover
These terms are an agreement between you and Keo Collective Pty Ltd T/A The Lead Engine (ABN 13 702 528 603, ACN 702 528 603) ("we", "us"). They cover your use of Lead Engine at crm.keocollective.com: the free lessons, the CRM, campaigns, microsites, email and text sending, social posting, bookings, Keo Call video meetings, analytics and any other feature we offer inside Lead Engine (together, "the service").
By signing up, ticking the box on our sign-up form or using the service, you agree to these terms and our Privacy policy. If you sign up for a business, you confirm you're allowed to agree on its behalf, and "you" means that business.
Lead Engine is for businesses. You must be 18 or older to use it.
What Lead Engine does
- Six lessons: short lessons that show you how to win and follow up clients. Each lesson sets up a tool in your CRM.
- Your CRM: your people, enquiries, stages, notes, inbox and calendar.
- Campaigns: follow-up emails and texts, microsites (landing pages), social posts and Google ad files. KEO can assemble a campaign for you from our pre-written, checked copy, filled in with the details you save on your Company page.
- Sending: emails and texts go out from Lead Engine on your behalf, to the people in your CRM.
- Keo Call: video meetings in your own meeting room.
- Analytics: page visits, sign-ups, email opens and where your leads came from.
We keep improving Lead Engine. Features may be added, changed or removed. If we remove something you pay for, we'll tell you first.
Your account
- Give us true and current details, and keep your sign-in private. You're responsible for what happens in your account, including anything your team members do.
- You can add team members. Each person needs their own sign-in.
- Tell us straight away at hello@keocollective.com if you think someone has got into your account.
Free lessons, free trial and price
- Lessons: the six lessons are free. You keep access to them even if you don't pay for the CRM.
- Free trial: the CRM is free for your first 14 days.
- Plan: after the trial, the CRM is $49 + GST a month, charged monthly in advance until you cancel. There's no lock-in contract.
- Emails and texts: you pay for the emails and texts you send by buying token packs. The pack price and what each pack includes are shown before you buy.
- Optional extras: some extras, such as a dedicated mobile number for texts or a campaign written for you, have their own price. We show the price before you choose them.
- Payments: payments are handled by our payment provider, Stripe. We don't see or keep your full card number. Prices are in Australian dollars. We'll send a tax invoice for each payment.
- Price changes: we'll give you at least 30 days' notice by email before a plan price changes. If you don't want to pay the new price, you can cancel before it starts.
- Failed payments: if a payment fails, we'll let you know. If it isn't fixed, we may pause sending and other paid features until it is.
Cancelling
- Cancel any time from Settings in your CRM. Your plan stays active until the end of the month you've paid for, then stops. Cancel before your 14-day trial ends and you won't be charged for the plan.
- We don't give refunds for part-months or for unused token packs, except where the law says we must (see "Your rights under Australian Consumer Law").
- After you cancel, you can still sign in to see and export your data for 90 days. After that we delete your account data, apart from records we must keep by law (for example billing records).
Your data and your content
- You own your data. The people, notes, messages, pages, photos, reviews and other content you put into Lead Engine belong to you (or the people who gave them to you).
- What you let us do with it: you give us permission to store, copy, process and display your content only as needed to run the service for you. For example, sending your emails, showing your microsites and drawing your posts. We don't sell your data.
- The people in your CRM: when you add your clients and enquiries to Lead Engine, you're responsible for them under the Privacy Act. We look after that information on your behalf and only use it to provide the service to you. Our Privacy policy explains how.
- Exporting: you can download your people list as a spreadsheet file while your account is open, and for 90 days after you cancel.
Your responsibilities when you send and publish
Lead Engine sends and publishes in your business's name, so you're responsible for what goes out. In particular:
- Consent (Spam Act 2003): only send emails and texts to people who agreed to hear from you or where the law allows it. Don't import bought or scraped lists. Lead Engine adds your business name and a working unsubscribe to every message, and stops sending to anyone who unsubscribes. Don't remove or hide these.
- Your industry's rules: check campaigns follow the advertising rules for your profession before you switch them on. For example, the rules of AHPRA, ASIC, the Tax Practitioners Board, your state's legal and building regulators, and the Australian Consumer Law. Our pre-written copy is checked against common rules for each industry, but it is general wording. It isn't legal advice, and it doesn't know everything about your business.
- True details: the Company page facts you save (licence and registration numbers, services, prices, guarantees, hours, response times) must be true. KEO builds your campaigns from them.
- Reviews and testimonials: only save reviews that are real, in the reviewer's own words, and that you have permission to publish. Only mark a review for use in ads if you have permission for that too.
- Photos and other material: only upload photos, logos and text you own or have permission to use.
- Nothing goes out until you approve it. Campaigns KEO assembles are drafts. Read them, change anything that isn't right for your business, and only switch them on when you're happy.
Things you must not do
- Send spam, or send to people who haven't agreed to hear from you.
- Publish anything false, misleading, defamatory, discriminatory or unlawful, or fake reviews.
- Use Lead Engine to collect passwords, card numbers or government ID from people through your pages.
- Break into, overload, copy, scrape or reverse-engineer the service, or get around its limits or security checks.
- Resell Lead Engine or let people outside your business use your account.
- Upload viruses or harmful code.
If you break these terms, we may pause sending, take down a page or post, or suspend or close your account. Where it's reasonable, we'll tell you first and give you a chance to fix it.
KEO and the writing features
- KEO assembles campaigns from pre-written copy in our knowledge base. It fills in your details and picks the pieces that match what's true for your business.
- Some optional features use an AI model to polish or write words for you. AI-written words can be wrong or unsuitable. Always check them before you use them.
- You're responsible for the campaigns you approve and send, however they were written.
Other services we connect to
Parts of Lead Engine work with services run by other companies, for example Stripe (payments), Cloudflare (hosting, email sending and security checks), Texto (text messages), Buffer (posting to your social accounts, if you connect it) and Anthropic (AI writing features). When you connect or use one of these, their own terms may also apply. We're not responsible for services we don't run, but we choose them carefully and only share what's needed. Our content
Lead Engine, the lessons, templates, knowledge base, pre-written copy, designs, logos and software belong to us or our licensors. While your account is open, you may use them inside Lead Engine and publish the campaigns, pages and posts you make with them for your own business. You keep that right for anything you have already published. You may not copy the lessons, templates or knowledge base to sell or share outside Lead Engine.
Keeping Lead Engine running
We work to keep Lead Engine available and your data safe, but we can't promise it will always be available or error-free. We may need to pause it for maintenance, usually outside business hours. Emails and texts depend on other networks and can be delayed, filtered as junk or not delivered.
Your rights under Australian Consumer Law
Our services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms takes away those rights. Where the law lets us limit what we must do when a guarantee is broken, our responsibility is limited to supplying the service again or paying the cost of having it supplied again.
Limits on our liability
- To the extent the law allows, we're not liable for indirect or consequential loss, such as lost profits, lost clients or lost data you could have exported.
- To the extent the law allows, our total liability to you for anything to do with the service is limited to the fees you paid us in the 12 months before the claim.
- We're not responsible for the content you send or publish, or for your compliance with the rules that apply to your business.
If a claim is made because of your content
If someone makes a claim against us because of content you sent or published through Lead Engine, or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim. This doesn't apply to the extent the claim was caused by us.
Closing accounts
You can close your account at any time by cancelling. We may close your account with 30 days' notice for any reason, or straight away if you seriously or repeatedly break these terms or the law, or don't pay. If we close your account without you breaking these terms, we'll refund any unused prepaid plan fees.
Changes to these terms
We may update these terms. If a change matters to you, we'll email you at least 30 days before it starts. If you keep using Lead Engine after that date, the new terms apply. If you don't agree, you can cancel before then.
General
- These terms are governed by the laws of Victoria, Australia. You and we accept the courts of Victoria.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- These terms and our Privacy policy are the whole agreement between us about Lead Engine.
